Taking a slightly different bent. What if the Japanese had bombed only civilian targets and killed only civilians on their attack on Hawaii? Would it be Holders contention Hirohito be tried in a Federal court rather than a military one?
I ask the question because it seems to set a legal separation between an attack on the civilian population of the State and that of an attack on the State itself. So someone could kill 500,000 Americans and it not be deemed an act of war, but criminal activity. Extend that a little further and the concept essentially means that civilians are fair targets not worth defending by the State.
I don’t think that is what most taxpayers would consider as appropriate use of 30% of their individual taxes go for.
