    This is great. Like the stupidity of both federal subsidies for Tobacco and anti-tobacco efforts, we are now embarking on killing jobs with CnT but burning through another several billion with a ‘jobs bill’.

    Here’s what I want to know. Why is it that there has been little mention of Tax Cheat Tim giving Freddie and Fannie their handouts? That was another $800bn that just got dropped down the toilet.

    Red Herring. EPA is a Creature of Congress. All Congress has to do is pass a bill stating that CO2 IS NOT a green house gas. Then place the EPA’s continued funding contingent on compliance.

    End of story.

    Anybody stating otherwise is blowing smoke.

    And the SCOTUS has already ruled that the EPA has the authority to regulate Co2, so you might see EPA take congress to court, should congress try to interfere.

    The states have to tell the EPA to stuff it, just like everything else, the states are the only ones who can put a full stop on all this nonsense.

    The long and short of the whole CO2 mess —

    4. EPA’s alternative basis for its decision—that even if it has statu-
    tory authority to regulate greenhouse gases, it would be unwise to do
    so at this time—rests on reasoning divorced from the statutory text.
    While the statute conditions EPA action on its formation of a “judg-
    ment,” that judgment must relate to whether an air pollutant
    “cause[s], or contribute[s] to, air pollution which may reasonably be
    anticipated to endanger public health or welfare.” §7601(a)(1). Under
    the Act’s clear terms, EPA can avoid promulgating regulations only if
    it determines that greenhouse gases do not contribute to climate
    change or if it provides some reasonable explanation as to why it
    cannot or will not exercise its discretion to determine whether they
    do. It has refused to do so, offering instead a laundry list of reasons
    not to regulate, including the existence of voluntary Executive
    Branch programs providing a response to global warming and im-
    pairment of the President’s ability to negotiate with developing na-
    tions to reduce emissions. These policy judgments have nothing to do
    with whether greenhouse gas emissions contribute to climate change
    and do not amount to a reasoned justification for declining to form a
    scientific judgment. Nor can EPA avoid its statutory obligation by
    noting the uncertainty surrounding various features of climate
    change and concluding that it would therefore be better not to regu-
    late at this time. If the scientific uncertainty is so profound that it
    precludes EPA from making a reasoned judgment, it must say so.
    The statutory question is whether sufficient information exists for it
    to make an endangerment finding. Instead, EPA rejected the rule-
    making petition based on impermissible considerations. Its action
    was therefore “arbitrary, capricious, or otherwise not in accordance
    with law,” §7607(d)(9). On remand, EPA must ground its reasons for
    action or inaction in the statute. Pp. 30–32.

    The EPA did not want to address the issue. The State of Mass sued. The whole case is here. The SCOTUS case hinged on ruling that EPA had statutory authority. Congress can mandate CO2 is not a GHG. Or the EPA, in light of the findiings that are showing up about Climategate, make a determination that the state of the issue is unsettled and defer moving forward.

    Just my opinion.

    Ugh, in that case Kalifornia is screwed again. Our “Republican” governor wants the rest of the states to follow his example of setting up a state run Cap & Trade scheme by 2012. I’m sure the other governors are saying to him, “Yeah Arnold, great idea! We can use all the jobs your state cares to export!”

    It’s not even 10:00 yet and my head is already hurting…

    BTW, I agree with Justrand. Constantly proclaiming the communist legislation is “dead” is nearly as annoying as Napolitano saying the “the system worked”. The communists are merely dithering on which anal probe to use on the country next.

    Yeah, why bother to pass this when the epa will simply issue an imperial decree who plain ole air will destroy whats left of our industrial base lol

    Amnesty is up next – now that the “carrot” of “free” HC will be available for them new “$500 fine” citizens (I am sure the SEIU or some other Soros front group will be glad to pay that “fine” on the way to signing em up to vote!) down a the local MediCaide office since that will be greatly expanded or they can get a huge subsidy check from the taxpayer to buy it on the “private insurance exchange”….

    Seriously, nobody on here really belevies that we have anything but a National HC system after CrappyCare passes?

    Its run in Washington and simply adminstered by a private company like medicare advantage (and we see how quickly that can be trashed in favor of an overt government run plan) and once they are run out of business its NHS care baby!

    Actually it was 6 States that started this crap to begin with. So I don’t think you will find relief via that route.

    Well, let those states destroy their economies, and the red states will reject it. ONe thing MFG has been right about, we cannot expect the deep blue states to come to their senses; they will double down on socialism.

    The red states will have to stand up for themselves, and that means no more federal cash.

    The only reason America has lasted this long is that the states have been left alone (relatively speaking) to develop their own way of life.

    Now that the Feds are centralizing everything, and forcing everyone to live the life of an east German citizen in 1974, the states have to draw the line, if they won’t, then fighting will break out, and a very long agonizing split will occur in the nation as the people rebuild local governments from the ground up.

    Forget state governments in that case, it’ll be county by county….

    The “authority” to do so comes from congress, scotus only confirmed that was so under the CURRENT enabling legislation. An agency of the gubmint has no standing to take the entire legislature to court, as their very creation depends on the legislature to begin with.
    Congress could eliminate the EPA in toto, if they had the balls to do so,Hence they can also limit their authority if they so desire.

    Cap and Trade….not dead. Absolutely everything Obama said he wanted when he was campaigning (including that energy prices would “necessarily skyrocket”) will happen because he will break knee caps to make it so. From healthcare and cap and trade, to income re-distribution with no fancy label…they will simply call it “income re-distribution” to collect what healthcare and cap and trade missed. The masses will shout I love big brother while the rest of us drink our victory gin until we pass out.
