There is a stream of stupidity floating around the election that Nancy Pelosi could become acting POTUS. Latest article I saw spouting this drivel is here. Well for convenience permit me to show how exactly unlikely that is. Fact I would have a better chance of becoming a billionaire than Pelosi becoming acting POTUS.

The components of this conundrum:

  • Time line of Electors
  • Line of succession
  • The qualifying Amendments

Line of succession

Lets dispel a specific fact that most of the authors of this tripe have been using –

The 25th Amendment DOES NOT APPLY in the confluence of events of a Presidential election

There are no ifs, ands, or buts about this. The 25th Amendment addresses the line of succession for a sitting President. Fact it does not even cover issues of a President-elect.


Time line of Electors

There has been a great deal of concern about confusion post Nov 3rd considering the number of States that are permitting mail in voting. Well first of lets define what will really happen before launching into conjecture. The timeline:

  • Election Nov 3rd.
  • Election results resolved Dec 8th
  • Elector Qualification certified Dec 8th
  • Electors cast ballots Dec 14th
  • Ballots tendered to Senate Dec 23rd
  • Ballots counted in joint session Jan 6th
  • POTUS sworn in Jan 20th

So what is at issue?

  1. The post election mail in ballot morass ends Dec 8th. There is not wiggle room here its a hard date. You don’t have to believe me, look at the timeline of why the SCOTUS stepped in quickly in the election of Bush v Gore. They quashed any issue related to ballots on the 12th because FL electors had to cast their ballots on the 14th.
  2. If electors cannot be qualified or the election results for that state can’t be certified the process does not stop. The State in dispute cannot forward electors hence loses the vote for President. For example, if Texas cannot certify the election and electors on the 8th their 38 EVs are null.
  3. Any State whose ballots have not be received on or before the 23rd are null and void. So if California can’t keep the lights on and that prevents them from getting their votes in till the 25th? Tough, they are not to be counted. 55 EVs gone.
  4. Speaker of the House. The Constitution does not mandate a date for election of Speaker. If the Democrats were to retain the House it would be to Pelosi’s advantage to delay her reelection. Would the Republicans regain the House it would be to their advantage to call for an immediate vote in the first day of the first session of the House.

Qualifying Amendments

There are two:

  • The 12th Amendment
  • The 20th Amendment

Specifics of the 12th

  • The various State electors shall cast their ballots. One set for President. One set for Vice President. The name and quantity cast shall be tabulated and forwarded to the Senate.
  • The greatest number of votes for President shall become President. The greatest number of votes for Vice President shall become Vice President.
  • In the event there is no clear majority for President then the top 3 candidates with votes cast shall be forwarded to the House. Balloting shall commence each State getting one vote. Simple majority indicates the winner. Only 2/3rds of the States be needed for a quorum to ballot.
  • Similiary, the person with the greatest number of votes shall become Vice President. If no clear majority in similar fashion of the President the Senate shall take up the 2 highest number of votes for candidates. 2/3rds of the whole numbers of Senators constitutes a quorum and a simple majority vote shall constitute the winner for Vice President.
  • No one can become Vice President if they could not qualify for being President.

Specifics of the 20th

  • The terms for Senators and Congressmen expire at noon on the 3rd of January.
  • Congress is to assemble for the first time at noon on 3rd of January.
  • If the President-elect dies before the oath, then the Vice President-elect assumes the office and is sworn in. If a President has not been selected the Vice President-elect shall assume the duties till the President has been selected. If either case fails it falls to Congress to select a President till such time as President and Vice President shall be qualified.

Bottom Line

For Pelosi to become temporary President the following would have to occur:

  1. She has to be reelected to her district. History as a guide says that is a near certainty.
  2. There would have to be a inconclusive result in the electoral college as to a majority winner for President so that the deadlock is passed to the House.
  3. The House would have to be in a deadlock past January 28th in selecting the President AND there has not been a clear majority for Vice President AND that the selection of Vice President would have to be in deadlock past the January 28th.

Between the demands for Electoral College and process required, the chances of Pelosi becoming temporary POTUS are as slim as the US paying off the National Debt. If the House is in deadlock but a Vice President elect has been determined that individual would be sworn in as acting President till the House has completed the selection. The issues about the popular vote are killed off on December 14th. After that date it is all Electoral College process all the way. Its why the Dims hate it of course. I would also point out that Hillary’s call for Biden not to concede is kind of childish for the very reason that the Electoral process is a freight train that cannot be stopped and for good reason.

    With all the consolidations, airlines have a virtual monopoly from many cities. For example, the only direct flight choice from Detroit to most destinations is Delta. Your choices are either choosing other major carriers with connecting flights (doubling, tripling your flying time), taking Spirit Airlines, which I wouldn’t wish on 10% of Democrats or paying outrageous Delta fares. Now the option is not traveling.

    In recent years, with their virtual monopolies, airlines have started charging for bags, and charging for things that were previously free (changing reservations or taking an earlier flight, etc.). That is changing.

But from what I can conclude right now, if the Dims expect to pull off a mail-in balloting miracle their effort for the scheme should be before the election not after. The various state deadlines after the election don’t give them much wiggle room.

    36 – Yup, Nolan could probably have commanded even more (though he was the first to make 1m$~1980). Then again those guys played in time when shit was still fairly affordable to attend live, politics in the league and at the stadium was nearly non-existent, and multi-millions per season (except in very later years of both careers), was not a wide spread thing, and for the most part those first making that kind of money tried to care about their image on and off field (at least publicly).

    Just booked the SO roundtrip DFW to SVO, $800. Usually in $1200-1400 range.

    If you ever wanted to visit there this month and next are some of the best times to go. Winter is not quite in full swing (73f/58f right now) and if you only have one choice St. Petersberg is it. Its a disneyland built by a czar.
