Should One’s Religion Play a Role in the Courts?

If the perp were Christian, Jewish or even Mormon, it wouldn’t, but apparently if the religion is something else judges believe it should (at least according to a decision made in Nebraska).

I know what you are thinking, but in this case the perp was Hindu, not Muslim. But, it still demonstrates how Balkanized our country is becoming, with special dispensation for immigrants.

The man who stabbed his wife twice last summer will not be sentenced to prison, a judge determined Thursday afternoon.

Navinkumar Patel, 46, of Shawnee, was arrested in late June 2015 after he stabbed his wife in the abdomen at Lawrence’s Super 8 Motel, 515 McDonald Drive, which he owns. He pleaded no contest to felony charges of attempted second-degree murder and criminal threat in March.

After Patel’s plea, Douglas County District Court Judge Robert Fairchild ordered him committed to Larned State Hospital for a mental health evaluation.

Thursday, Patel appeared in court to be sentenced. Fairchild sentenced him to probation, the terms of which have not yet been decided, however.

In court, the doctor who evaluated him, Bradley Grinage, testified that Patel suffers from bipolar disorder, an illness that was exacerbated by alcohol addiction.

If Patel stops drinking and continues to take his medication, Grinage said he is at a low risk for a repeat offense.

More than a dozen of Patel’s family members, including his wife, showed up in court Thursday to support him. Many wrote letters to Fairchild, asking him to sentence Patel to probation.

Patel’s attorney, John Kerns, called the case “unusual, to say the least.”

Kerns told Fairchild that in the Hindu culture of Patel’s family, his wife and children would also suffer if he were sentenced to prison. They would essentially be “ostracized,” he said.

Not only did Patel’s family vouch for his character, Kerns said, but they were also willing to ensure that he continues to remain sober and sticks to his medication regimen.

Isn’t being “ostracized” a key component of punishment in the US legal system? Shouldn’t Patel by “ostracized” more for stabbing his wife than for going to prison?

    Separation of church and state only seems to apply o Christianity these days.

    This is just another example of today’s immigrants continuing to live with the values of the hell hole from which they came and the government promoting it.

    Interesting posting. Here is where secularism fails. Separation of church and state works fine when one is attempting to not have a state religion, agnostic in viewpoint. But when in comes down to the law itself, it is deeply rooted in religion. It why the frieze over the supreme court building lists the law givers, nearly all of them religious leaders. —

    Paper ballots, ONE DAY of voting, Purple Fingers, voter ID!!

    Go back to the old system, whereby you had to request an “Absentee Ballot” in advance. And NO “same day registration”.

    I have never understood the need for the ‘same day registration’ bit once the motor voter bill was passed by Congress. Technically your valid driver’s license/State ID is your registration.

    Same day registration allows the last minute registration of grave stones, leaving no time for verification.
